Terms of Service

Rules for using Nikonyx. Last updated 28 October 2026.

These Terms of Service (“Terms”) govern your use of the Nikonyx consumer application at app.nikonyx.com, related mobile experiences when available, Friends Space features, and the marketing website at nikonyx.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

Brand / catalogue partnerships may be covered by a separate written agreement. If there is a conflict, the partner agreement controls for that commercial relationship.

1. Who may use Nikonyx

  • You must be at least 16 years old (or the higher digital-consent age in your country), or use the Service only with verifiable parental/guardian authority where required
  • You must provide accurate account information and keep credentials confidential
  • One person or organisation should not create accounts to evade bans or abuse limits

2. The Service

Nikonyx provides AI-assisted styling tools, including digital wardrobe management, outfit recommendations, virtual try-on previews, outfit saving, and social features (Friends Space). Features may change, be limited by geography, or require an internet connection. We may introduce beta features that are experimental and less reliable.

Mobile app store availability is announced separately; until then the primary consumer product is the web app.

3. Accounts

You are responsible for activity under your account. Notify support@nikonyx.com promptly if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms, create risk, or remain inactive for an extended period after notice where required.

4. Your content & licence

“User Content” means photos, videos, text, wardrobe items, measurements, messages, posts, and other material you submit. You retain ownership of your User Content.

You grant Nikonyx a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt (for format/optimisation), display, and otherwise use User Content solely to operate, secure, and improve the Service features you use (including try-on, recommendations, and sharing you enable). This licence ends when User Content is deleted from our active systems, subject to reasonable backup and legal retention windows described in the Privacy Policy.

You represent that you have the rights needed to upload User Content and that it does not infringe others’ rights or violate law.

5. Styling, try-on & size guidance (important)

  • Outfit suggestions are decision aids based on available wardrobe/shop data and your inputs—they are not professional fashion, medical, or safety advice
  • Virtual try-on is a visual preview, not a guarantee of physical fit, fabric drape, colour fidelity, or how a garment will look in person
  • Size and fit guidance is suggestion-only; always verify with brand size charts and return policies before purchase
  • Shop / catalogue availability, pricing, and stock can change; we are not responsible for third-party retailer fulfilment

6. Friends Space & social features

If you use social features, you agree to:

  • Respect others’ privacy and content permissions (including repost / reuse / find-similar controls)
  • Not harass, threaten, spam, or impersonate others
  • Not post illegal, sexual content involving minors, or content that exploits others

We may remove content, limit distribution, or restrict accounts that violate these rules or applicable law. You can report concerns via in-product tools where available or by emailing support.

7. Acceptable use

You agree not to:

  • Reverse engineer, scrape private media, bypass access controls, or overload the Service
  • Upload malware or attempt to disrupt security
  • Use the Service to build a competing dataset by systematically extracting others’ private wardrobe or body media
  • Misrepresent AI outputs as guaranteed fit or as human-verified professional advice
  • Use automated bots except through documented APIs we expressly provide

8. Third-party services & links

The Service may link to third-party stores, payment providers, or model/cloud vendors. Their terms and privacy practices apply to their services. Nikonyx is not responsible for third-party sites or offline purchases you make.

9. Intellectual property

Nikonyx, its logos, UI, software, and marketing materials are owned by us or our licensors. These Terms do not grant you rights to copy or brand Nikonyx except for personal, non-commercial use of the Service as provided.

10. Feedback

If you send ideas or feedback, you grant us a perpetual, royalty-free licence to use them without obligation to you.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT RECOMMENDATIONS OR TRY-ON PREVIEWS WILL MEET YOUR EXPECTATIONS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIKONYX AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.

13. Indemnity

You will defend and indemnify Nikonyx against claims arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.

14. Suspension & termination

You may stop using the Service at any time and request account deletion via support. We may suspend or terminate access for violations, risk, or legal reasons. Sections that by nature should survive (including licences for residual backups, disclaimers, and liability limits) survive termination.

15. Changes to the Service or Terms

We may update the Service and these Terms. We will update the “Last updated” date and provide additional notice for material changes where required. Continued use after the effective date constitutes acceptance, except where local law requires explicit consent.

16. Governing law

Unless mandatory local consumer law says otherwise, these Terms are governed by the laws of England and Wales, and courts there have exclusive jurisdiction, subject to any non-waivable rights you have in your country of residence.
